RULES
1. No purchase necessary to enter. 1000 finalists will be selected by judges (Tui Tai Expeditions and Eric Nies). Finalists will be selected based on the strength of their entry profile.
2. Sponsor: The sponsor of this Tui Tai Expeditions, located at Main Street, Savusavu, Fiji Islands ("Sponsor").
3. Eligibility: Fiji Reality Competition ("the Competition") is offered to applicants who at the time of entry are 18 years of age or older and have pre-existing internet access. The Competition is subject to all applicable federal, state and local laws and regulations.
4. How to Enter: The competition begins at 12:00 AM Pacific Standard Time ("PST") on December 27, 2009 and ends at 12:00am AM PDT on March 27, 2010. To enter, visit http://www.FijiRealityCompetition.com and complete the required entry fields of your first name, last name, entry type, email address. The use of information submitted shall be subject to the Sponsor’s privacy policy, which can be viewed here:
Entries are the property of Sponsor and will not be acknowledged or returned.
5. Prize Awarding and Entry Periods: Prize winners will be selected based on the count of votes submitted by all finalists. The 5 highest male and female finalists will win the grand prize. Winners will be announced February 22, 2010 and have 48-hours to claim their prize.
Sponsor’s decisions will be final in all matters relating to the Competition and winner eligibility. The potential winners will be notified by email. The potential winners will be allowed 48-hours to claim the prize. The potential winner must respond within forty-eight (48) hours from the date of notification by Sponsor or the prize will be forfeited and awarded to an alternate winner by virtue of the next highest vote tally. If any prize notification is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner by virtue of the next highest vote tally.
6. Prizes and Approximate Retail Value: There will be ten Grand Prizes in total. Grand Prize will be: all-expenses paid trip to Fiji, 7-nights Expedition on the Tui Tai, April 12-19, 2010. The Grand Prize has a total combined Average Reatil Value of $6500.00 US Dollars.
7. General: By entering, entrants agree to release and hold harmless Sponsor and each of its parents, subsidiaries, divisions, representatives, affiliates, advertising and promotional agencies, wholesalers, retailers, partners, suppliers, any company presenting any part of the prize, and each of the foregoing entities’ employees, officers, directors, owners, agents, successors and assigns (collectively the "Released Parties"), from and against any and all costs, expenses, claims, demands, proceedings, suits, actions and/or liabilities for any injuries, death, loss or damage of any kind arising from or in connection with accidents, terrorism, theft, natural disaster, the promotion of the Competition, the distribution of any prize, entrants’ participation in and/or entry into the Competition, acceptance or use of any prize by any entrant or Guest or unavailability of any prize. PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND FROM SPONSOR. All entrants acknowledge that companies presenting any part of a travel prize in connection with the Competition are independently owned and operated and are not controlled by Sponsor.
The Competition shall be governed by, and construed in accordance with the laws of Fiji. All federal, state and local laws and regulations apply. All entrants agree that the Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Sponsor due to technical problems, human error or traffic congestion on the internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Auction, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, incomplete and/or unintelligible (or any combination thereof).
Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, abbreviate or suspend the Competition or any portion thereof for any reason without further obligation or advance notice. If the Competition is not capable of running as planned by Sponsor, notice will be posted on www.tuitai.com and www.FijiRealityCompetition.com. In the event that the Competition is abbreviated for any reason, the Sponsor reserves the right at its sole discretion, but is under no obligation, to award prizes from among all valid and eligible entries received up to the time of termination.
By entering, entrants agree to comply with these rules. Any entrant who attempts to tamper with the Competition, in Sponsor’s sole discretion, shall be disqualified. In the event of a dispute as to who submitted an entry, the Entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" means the natural person assigned to an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES TO THE EXTENT ALLOWED BY LAW) FROM ANY SUCH ENTRANTS TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
If any portion of these rules is determined to be invalid or illegal, the remaining portions of these rules will remain in effect and be construed with their terms as if the invalid or illegal provision were not contained herein.
8. Use of Information: The information provided on the Competition entry form, online profile, or in connection with winning a prize may be used in accordance with Sponsor’s privacy policy which can be viewed at www.tuitai.com/privacy.php
